ELIGIBILITY:  This contest (“Contest”) is sponsored by Heritage Foods USA and Good Shepherd Poultry Ranch (“Sponsors”), and is open only to legal residents of the 50 United States (and the District of Columbia) who are age 18 and older as of the time of entry.  Employees of Sponsors and members of their immediate family or persons living in the same household (whether related or not) are NOT eligible to participate in Contest.  Void where prohibited.  To enter on-line, follow directions displayed on-line.  Entries are not transferable. No mechanically reproduced entries will be accepted. Each entry received will have an equal chance to win.

AGREEMENT TO OFFICIAL RULES: By participating in the Contest, each eligible participant (“Participant”) fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsors, which are final and binding in all matters related to the Contest. The Sponsors reserve the right at its sole discretion to cancel, terminate, modify or suspend the Contest.

HOW TO ENTER: During the Contest Period, (the “Entry Period”), 1) go to HeritageFoods.com/Contest; 2) upload a photo of a Heritage breed turkey to the site. All online posts must be done between 12:01 AM ET of June 1^stand 11:59 PM ET June 30^th2018 to be eligible. Multiple entries received from any person or email address after the first entry received from that person or email address will be void. Entries generated by script, macro or other automated means or means which subvert the entry process will be void. All entries become the property of the Sponsors and will not be acknowledged or returned.

The Contest must be entered by submitting an entry using the online form provided at HeritageFoods.com/Contest. Entrants may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If any entrant is found to use fraudulent methods or otherwise attempt to circumvent the rules, at the sole discretion of the Sponsor, the entrant’s submission may be removed from eligibility.

WINNER SELECTION: Winners will be selected on or about July 15^th, 2018 based on the highest number of “votes” from all eligible photo post entries. In the event the Sponsors do not receive any eligible entries, the Sponsors have the right to cancel the Contest. A review and tally of the number of “likes” will be conducted by the Sponsors, whose decisions shall be final. Acceptance of prize constitutes permission to use winner’s photo, name, city, state of residence and comments in advertising and promotional materials unless prohibited by law.

PRIZE and APPROXIMATE RETAIL VALUE: The First (1^st) Place Winner will receive Culinary Trip for two to NYC, (ARV $2,500.00 total).  The Second (2^nd) Place Winner will receive a Kikuichi Cutlery Knife Set (ARV $1,000.00 total). The Third (3^rd) Place Winner will receive a $500.00 Gift Card to Heritage Foods USA retail store. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsors’ sole discretion. Sponsors reserve the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and feesassociated with prize receipt and/or use. Odds of winning depend on the number of eligible entries received.

WINNER NOTIFICATION: Winners will be notified within one (1) week of the last day of the Contest, via email, and/or at Sponsor’s discretion. In the event Winner doesn't respond to Sponsor's notification or does not accept the prize within five (5) business days of notification, the prize will be deemed forfeited and an alternate Winner will be selected. In the event that any one or more potential Winner(s) fail(s) to respond as stated above, declines the prize or fails to provide signed affidavits or releases, such Winner(s) will be deemed to forfeit the prize and Sponsors will select an alternate Winner(s) from the remaining eligible entrants. If any alternate(s) similarly fails to respond or declines the prize, Sponsors will use a reasonable number of attempts, in its discretion, to award the prize(s) to another alternate(s) but if it is unable to do so, the prize(s) will be finally forfeited and Sponsors shall have no further liability in connection with this Contest.

LIST OF WINNER(S):  For the names of the Winners, send a separate self-addressed, stamped envelope to Contest Winner List, Heritage Foods USA, 217 W 18th St #1219, New York, NY 10011within two (2) months from the Winner notification date as specified above.  

CONDITIONS OF PRIZE PARTICIPATION:  Expenses not specifically included in prize description and all taxes are each Winner’s sole responsibility.  Each prize is awarded "as is" with no warranty or guarantee, either express or implied outside of manufacturer's limited warranty.  No transfer, assignment or substitution of a prize permitted, except Sponsors reserve the right to substitute prize for an item of equal or greater value in the event an advertised prize is unavailable.  Winner is required to comply with any and all applicable federal, state, and local laws, rules and regulations.  All federal, state and local taxes, and any other costs not specifically provided for in these Official Rules are solely the Winner's responsibility. If the actual retail value of any Winner's prize is $600 or more, the Winner must complete a W9 form and supply Sponsors with his/her social security number for tax purposes.  Sponsors will issue an IRS Form 1099 in the Winner’s name for the actual value of the prizes received. Sponsors shall have no responsibility or obligation to the Winner or potential Winner who are unable or unavailable to accept or utilize prizes as described herein. Participants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Contest.  Winner may be required to sign and return an Affidavit of Eligibility, a Liability Release and where legally permissible a Publicity Release within seven (7) days following the date of first attempted notification.  Failure to comply with this deadline may result in forfeiture of the prize and selection of an alternate Winner.  Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate Winner.  By accepting prize, Winner agrees to hold Sponsors, their advertising and promotion agencies and their respective parent companies, retail partners, subsidiaries, affiliates, partners, representative agents, successors, assigns, officers, directors, and employees harmless for any injury or damage caused or claimed to be caused by participation in the Contest or acceptance or use of the prize.  Sponsors are not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize.

NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES/SEVERABILITY: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and each Participant expressly waives any and all such rights. In the event that a court of competent jurisdiction finds the foregoing waiver unenforceable, Participants hereby consent to the jurisdiction and venue residing exclusively within the federal or state courts sitting in New York County in the State of New York and agree that any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action. Entrants agree that these Official Rules are governed by the laws of the State of New York, without reference to principles of conflicts of law. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
